This website is operated by Tricia's Gems. Throughout the site, the terms “we”, “us” and “our” refer to Tricia's Gems. Tricia's Gems offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.
We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in British Columbia, Canada for the resolution of any disputes arising out of or relating to these Terms of Service or your use of our Services.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. All content on this website — including but not limited to product photographs, jewelry designs, graphics, logos, text, descriptions, and other materials — is the exclusive property of Tricia's Gems and is protected by Canadian and international copyright, trademark, and intellectual property laws.

Unauthorized copying, reproduction, distribution, modification, or use of any content from this website is strictly prohibited. We have implemented technical measures to protect our content, including copy protection on text and images. Attempts to circumvent these protections may constitute a violation of applicable law.

Any unauthorized use of our intellectual property may result in legal action.

SECTION 21 - AMETHYST HAVEN SPIRITUAL SERVICES

Amethyst Haven is a spiritual services offering provided by Tricia's Gems. The following terms apply to all bookings and sessions made through this service.

Cancellation & Rescheduling Policy

We require a minimum of 24 hours’ notice for any cancellations or rescheduling requests.

  • Cancellations with more than 24 hours’ notice: eligible for store credit or rescheduling
  • Cancellations within 24 hours: non-refundable
  • No-shows: non-refundable and non-transferable

Late arrivals may result in a shortened session to avoid impacting other scheduled appointments.

Refund Policy

All spiritual services, readings, and sessions are final sale.

Due to the time-based and experiential nature of these services, we do not offer refunds once a session has been completed or missed.

If you are unable to attend, please contact us in advance to reschedule within the allowed timeframe.

Disclaimer & Client Responsibility

All services offered—including tarot readings, oracle guidance, mediumship, and energy work—are provided for personal insight, spiritual exploration, and entertainment purposes only.

These services are not a substitute for professional advice, diagnosis, or treatment. They do not replace medical, psychological, legal, or financial guidance from a qualified professional.

By booking a session, you acknowledge and agree that:

  • You are solely responsible for your own decisions, actions, and interpretations
  • All information provided is subjective and open to personal interpretation
  • No guarantees are made regarding accuracy, outcomes, or results
  • Services are intended for individuals 18 years of age or older

Tricia’s Gems and its practitioners are not liable for any decisions made or actions taken based on the information provided during a session.

Conduct & Right to Refuse Service

We reserve the right to refuse or terminate a session at any time if a client is:

  • Disrespectful or inappropriate
  • Under the influence of drugs or alcohol
  • Not in a suitable state to participate in a session

In these cases, no refund will be provided.

SECTION 22 - DISPUTE RESOLUTION

In the event of any dispute, claim, or controversy arising out of or relating to these Terms of Service or your use of our Services, the parties agree to first attempt to resolve the matter informally by contacting us at tricia@triciasgems.com. We will make reasonable efforts to address your concern within 30 days.

If the dispute cannot be resolved informally, both parties agree to submit to the exclusive jurisdiction of the courts of British Columbia, Canada, as set out in Section 18. Nothing in this section limits either party's right to seek injunctive or other equitable relief for urgent matters.

SECTION 23 - JEWELLERY REPAIR SERVICES

By submitting jewellery, watches, gemstones, or other items for repair, cleaning, sizing, restoration, engraving, stone setting, or modification, you acknowledge and agree that certain items may contain pre-existing damage, weakened settings, brittle stones, worn components, aged materials, prior repairs, or hidden manufacturing defects that may not be visible prior to service.

Tricia’s Gems is not responsible for damage resulting from normal repair procedures where pre-existing structural weaknesses, hidden defects, or material deterioration exist.

Certain gemstones and materials — including but not limited to opals, emeralds, pearls, amber, treated stones, hollow jewellery, and delicate vintage items — may be especially vulnerable during repair, cleaning, soldering, polishing, sizing, or stone-setting procedures.

While Tricia’s Gems exercises reasonable care in handling and performing repair or restoration work on all items entrusted to us, customers acknowledge that certain repair risks cannot be completely eliminated due to the condition, age, materials, prior repairs, manufacturing methods, or structural integrity of the item.

Customers are responsible for informing us of:

  • Known treatments or enhancements

  • Prior repairs or alterations

  • Sentimental value

  • Fragile conditions

  • Special care requirements

Estimated repair completion dates are approximate only and are not guaranteed.

Repair charges are based on labour, materials, and complexity of work performed and may vary from original estimates if additional issues are discovered during the repair process.

Items not picked up within 90 days of customer notification may be considered abandoned and become the property of Tricia’s Gems unless prior written arrangements have been made.

SECTION 24 - PERMANENT JEWELLERY

Permanent jewellery services involve custom-fitted chains that are welded directly onto the wearer without a traditional clasp.

By receiving permanent jewellery services from Tricia’s Gems, you acknowledge and agree that:

  • Chains may stretch, weaken, snag, or break through normal wear

  • No guarantee is provided against accidental damage, stretching, or breakage

  • Customers are responsible for proper care and maintenance of permanent jewellery

  • Certain occupations, sports, travel, security screenings, or medical procedures may require temporary or permanent removal of the jewellery

  • Tricia’s Gems is not responsible for injury, allergic reactions, lost items, damaged items, or damages resulting from the wearing or removal of permanent jewellery

Permanent jewellery may contain metals that could cause skin irritation or allergic reactions in sensitive individuals. Customers are responsible for informing us of any known metal sensitivities prior to service.

Due to the custom, welded, and hygienic nature of permanent jewellery services, all permanent jewellery sales and services are final sale.

SECTION 25 - NATURAL STONES, CRYSTALS, AND HANDCRAFTED PRODUCTS

Many products sold by Tricia’s Gems are handcrafted or made from natural materials including gemstones, crystals, minerals, wood, glass, sterling silver, gold, bronze, and other precious or semi-precious materials.

Variations in colour, texture, pattern, shape, inclusions, oxidation, finish, carving, and appearance are normal characteristics of natural or handcrafted products and are not considered defects.

Natural stones and crystals may contain inclusions, fractures, surface markings, colour variations, or irregularities that are part of their authentic natural character.

Product photographs are intended as general representations only. Actual items may vary slightly from images shown online due to lighting, monitor settings, natural material variation, and handcrafted production methods.

Metaphysical, spiritual, or healing properties associated with crystals, gemstones, or spiritual products are provided for informational and entertainment purposes only and are not intended as medical, psychological, legal, or professional advice.

SECTION 26 - CUSTOM ORDERS AND SPECIAL ORDERS

Custom-designed, made-to-order, altered, engraved, resized, personalized, or specially ordered items are final sale and are not eligible for refund, exchange, cancellation, or return once production, ordering, or customization has begun.

Deposits made toward custom or special orders are non-refundable unless otherwise required by applicable law.

Customers are responsible for reviewing and approving all specifications, measurements, designs, gemstones, engravings, chain lengths, ring sizes, CAD renderings, and other order details prior to production.

Tricia’s Gems is not responsible for errors approved by the customer during the design or approval process.

Production timelines for custom and special orders are estimates only and may vary due to supplier availability, shipping delays, production schedules, or circumstances beyond our control.

SECTION 27 - SHIPPING, DUTIES, AND INTERNATIONAL ORDERS

Shipping and delivery timelines provided by Tricia’s Gems or shipping carriers are estimates only and are not guaranteed.

Tricia’s Gems is not responsible for delays caused by shipping carriers, customs processing, weather conditions, labour disruptions, supply chain interruptions, incorrect customer information, or circumstances beyond our reasonable control.

Customers are responsible for ensuring that all shipping and billing information provided at checkout is accurate and complete.

For international orders, customers are responsible for any applicable:

  • Customs duties

  • Import taxes

  • Brokerage fees

  • Tariffs

  • VAT charges

  • Government import fees

Unless otherwise stated, these charges are not included in product or shipping prices.

Risk of loss for shipped products transfers to the customer upon delivery of the package to the shipping carrier, subject to applicable consumer protection laws.

Tricia’s Gems is not responsible for lost, stolen, delayed, abandoned, or misdelivered packages once they have been transferred to the shipping carrier.
